SMS Terms & Messaging Policy

1. Who we are
These SMS Terms apply to text messages sent by PowderDay LLC ("PowderDay," "we," "us"), a Colorado limited liability company located at 6834 S University Blvd, #102, Centennial, CO 80122.

2. Our messaging programs
PowderDay operates two text messaging programs. Both are consent-based. You will not receive text messages from us unless you have affirmatively opted in.
Business inquiries. If you submit a contact form on powderday.net and provide a mobile number with consent, we may text you about your inquiry, scheduling, and our services.
Campaign responses. PowderDay builds and operates customer acquisition campaigns on behalf of financial services and insurance companies. If you submit a form on one of our campaign pages requesting information, and you check the consent box, PowderDay may contact you by phone call and text message about your request and the products or services you asked about. Consent is given to PowderDay and to the specific company named in the consent language on the form you completed. No other party is authorized to contact you as a result of that submission.
3. How you opt in
Consent is collected through a web form. In every case:
- The consent checkbox is unchecked by default. You must affirmatively check it.
- You type your own phone number. We never pre-fill, append, or infer a phone number.
- Consent to receive messages is never a condition of purchase or of receiving information.
- The consent language identifies every party authorized to contact you, before you submit.
- A record of your submission — including the date, time, the exact consent language displayed, and the information you entered — is retained.
We do not purchase, rent, or import phone numbers from third parties, contact lists, or lead marketplaces. Every number we message came from a form the person completed themselves.
4. What we send
Messages relate to the inquiry you submitted: responses to your questions, appointment scheduling and reminders, and information about the products or services you requested. Messages may be sent using an automatic telephone dialing system or with prerecorded voice for calls.
5. Message frequency
Message frequency varies based on your inquiry and your engagement with us. Most conversations involve a small number of messages over a short period.
6. Cost
Message and data rates may apply. PowderDay does not charge for text messages, but your mobile carrier's standard rates apply. Contact your carrier for details about your plan.
7. How to opt out
Reply STOP to any message to unsubscribe. You will receive a single confirmation message, after which we will stop sending texts to that number.
You may also revoke consent by emailing support@powderday.net or calling 866-284-3532, or by replying with any reasonable indication that you no longer wish to be contacted. We honor opt-out requests through any reasonable means.
A revocation received on any channel will suppress contact across all channels — phone, text, and email — for that number and record. We log every revocation with its timestamp and the channel it arrived on.
To resume messages after opting out, reply START or submit a new request with consent.

9. Carrier disclaimer
Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless service provider and is not guaranteed.
10. Supported carriers
Our messaging is supported on major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, and their affiliated regional and prepaid brands. Carrier support may change without notice.
11. Privacy and your opt-in information
We do not sell, rent, or share mobile phone numbers or SMS consent information with third parties for those parties' own marketing purposes.
Where you have submitted a request on a campaign page, the information you provided — including your phone number — is shared with the company named in the consent language on that form, for the purpose of responding to the request you made. That company is identified to you before you submit. No other sharing of your contact information for marketing occurs.
Consent records may be created and independently maintained by a third-party consent-certification provider engaged by PowderDay to document consent. That provider may capture and store a record of the page and consent language presented at the time of your submission, along with associated technical information.

12. Eligibility
Our messaging programs are intended for individuals located in the United States who are 18 years of age or older.
13. Changes to these terms
We may update these SMS Terms from time to time. The current version is always posted at powderday.net/sms-terms with the date it was last updated. Material changes affecting how we contact you will not be applied retroactively to consent already given.
